Genetic technology, as one of the modern scientific advancements, plays a significant role in the process of proving claims and uncovering the truth within the judicial system. However, issues related to the foundations of religious legitimacy, the possibility of errors, and ethical and legal challenges have caused hesitation in the absolute acceptance of genetic data in judicial governance.
This article aims to evaluate the position and validity of genetic data in the judicial process by examining the views of Martyr Ayatollah Seyyed Ebrahim Raisi — a figure qualified in jurisprudence, law, and managerial experience at the highest levels of the judiciary in the country.
The research method is descriptive-analytical and relies on library resources, judicial documents, and authentic statements of Martyr Raisi to analyze the jurisprudential, legal, and legislative dimensions of this issue.
The findings indicate that the use of genetic data in the judiciary, provided it is accompanied by principles such as scientific accuracy, privacy protection, and adherence to religious regulations, can be considered a valid supporting piece of evidence in the judicial process. Accordingly, drafting clear regulations, establishing an effective supervisory system, and strengthening the jurisprudential-legal foundation of this technology in judicial governance are essential.
